Oshkosh Ethanol Plant Settles Pollution Lawsuit

Utica Energy LLC, a firm that operates an ethanol production plant in Oshkosh, has agreed to pay $75,000 to settle allegations that the company violated state air and water pollution control laws.
The payment of penalties, fees, and costs will settle a case filed by the Wisconsin Department of Justice at the request of the Department of Natural Resources.
According to the complaint, Utica Energy violated several requirements of its air pollution control permit, including those that required ethanol be transported in “dedicated” tankers and that emission be routed through special equipment.
The company also allegedly failed to monitor wastewater discharges and report discharges that the complaint claimed violated permitted limits.
The settlement was approved by Winnebago County Circuit Court Judge Bruce Schmidt. Assistant Attorney General Shari Eggleson represented the state.
