State Sues Utica Over Ethanol Plant Violations

Oshkosh Northwestern:
The Wisconsin Department of Justice is suing Utica Energy LLC for violations of state air and water pollution control regulations, including illegally discharging wastewater onto fields and into waterways that feed in to Lake Winnebago.
The complaint, filed in Winnebago County Circuit Court on Aug. 8, indicates Utica violated nine regulations designed to prevent air and water pollution on multiple occasions dating back, in some instances, into 2003.
The lawsuit requests the courts fine the company $10 to $25,000 for each day the company is found to have violated air pollution control regulations and $25 to $25,000 for each day the company is found to have violated water pollution control laws.
Among the charges, the state claims Utica Energy:
EDischarged pollutants into waters of the state without a permit. The complaint indicates Utica “discharged polluted corn mash seepage into a drainage ditch that flows into an unnamed tributary of Sawyer Creek” on multiple occasions before Aug. 18, 2005. The company does not have a permit to discharge wastewater into state waters. Read on.
